Limited Warranty
Apogee Imaging Systems Inc. (“Apogee”) warrants that its products are free from substantive defects in materials and manufacturing, under normal use, for a period of two (2) years from the date of original shipment. Apogee further warrants that its products, when shipped, comply with the specifications contained in Apogee's data sheets current at the date of manufacture and per Apogee's standard test procedures.
Apogee will, at its option, repair or replace any product which Apogee deems to be defective within the warranty period. If Apogee can neither repair nor replace the product because it has become obsolete / discontinued during the life of the warranty, Apogee will substitute a product that Apogee deems to be as equivalent as possible. Apogee shall bear all costs of shipping products to/from Apogee to the customer's site for any confirmed out-of-box defects reported within 30 days of the original ship date. If, however, Apogee finds that the product does not have a substantive defect in materials or manufacturing and is in compliance with our specifications, Apogee reserves the right to charge the customer for all shipping and associated charges, plus labor. Apogee shall bear shipping costs for the return of products to the customer's site for all other in-warranty service issues. The customer is responsible for delivery of products to Apogee's factory in Roseville, California, USA. Customer shall bear all costs for the removal and reinstallation of the product at the customer's site.
This warranty is voided by: unauthorized modifications to the product; damage caused by power supplied to the product; damage caused by use of the product in extreme temperatures, excessive humidity, moisture, radiation, or electromagnetic fields; damaged caused by abuse or negligent handling; damage caused by use of the product after condensation has appeared in the inner chamber. Apogee specifically disclaims special, indirect, or consequential damages or lost profits which may result from failure of our products.
This warranty excludes (1) physical damage to the surface of the product, including scratches or cracks, (2) normal wear items, including shutters, and (3) damage caused by the device or system to which the product is connected. Apogee will, at its discretion, repair or replace any shutter found to be defective during the two year warranty period.
Apogee warrants the sealed chamber integrity of all our products for the lifetime of the product. If condensation appears in the inner chamber, Apogee will restore the inner chamber seal and its purge gas at no charge. Restoration of the inner chamber seal must be done at the Apogee factory. Apogee shall bear the costs of shipping the product to / from Apogee for any inner chamber integrity issues for the initial two years of the warranty period. After the initial two year warranty period, the customer shall bear the costs of shipping the product to / from Apogee for any inner chamber integrity issues. Note, if the customer continues to use the camera after condensation has appeared (and it will be obvious to us), the warranty on the CCD and other inner chamber components is void.
Software: The customer assumes responsibility for selecting software to achieve his intended results and for the use of and results obtained from any software used with Apogee products. Apogee software is not warranted to be error free. Apogee works to maintain compatibility with third-party software vendors; however, Apogee cannot guarantee compatibility with non-Apogee software.
Apogee products are not authorized for use as critical components in life support or medical diagnostic applications where failure to perform could be reasonably expected to result in injury, faulty diagnosis, or other risks to patients or personnel.
No other warranties are expressed or implied. Apogee does not warrant merchantability or fitness for a particular purpose. Apogee is not liable for incidental or consequential damages, or for the infringement of any patent rights or third party rights due to the use of its products. Apogee's entire liability shall be limited to repair, replacement, or refund of the purchase price paid, at Apogee's option.
This limited warranty shall be governed by and construed under the laws of the State of California.
Apogee reserves the right to refuse return of any product built-to-order, and the right to charge a 10% restocking fee on any products that we accept as returns.
